Chris Toh Pei Roo ― Tax, Customs & Trade Practice
Working alongside practice heads Dato’ Nitin Nadkarni and Jason Tan Jia Xin, Chris represents and advises taxpayers in all aspects of tax law. He is experienced in judicial review, having assisted taxpayers in challenging decisions by the Inland Revenue Board (IRB), the Royal Malaysian Customs Department and the Ministry of Finance in a wide range of tax disputes. He has also acted for taxpayers in tax appeals, defending civil recovery proceedings and resisting applications by the IRB under the Companies Act.
Chris speaks regularly on tax issues for various professional and trade organisations, including the Chartered Tax Institute of Malaysia (CTIM), the Malaysian Institute of Accountants, and the Federation of Malaysian Manufacturers. He is an Associate Member of CTIM and an examiner in Revenue Law for CTIM’s Professional Examinations and has been published in the Tax Disputes and Litigation Review, The Private Wealth & Private Client Review, and the Current Law Journal. He is a contributor to the Malaysian Civil Procedure (White Book) (2021 edition).
Chris holds a First Class LLB (Hons) from the University of Leeds, and an LLM in International Commercial Law from University College London. He was awarded the St Philips Chambers Prize for Commercial Dispute Resolution during the Bar Professional Training Course. He was admitted as an advocate and solicitor of the High Court of Malaya in 2017.
Joyce Ong Kar Yee ― Corporate and M&A; Projects & Construction Practice
Joyce works with Steven SY Tee, who heads the firm’s front-end Projects & Construction Practice. Her primary areas of expertise are the power, energy, construction and infrastructure sectors. She is highly experienced in the preparation of various project and construction documents, including in particular, engineering, procurement, construction and commissioning (EPC) contracts. Joyce also has an active corporate and commercial practice, where she focuses on mergers and acquisitions (M&As), particularly in the private equity sphere.
She advises local and international clients, including multinational corporations and government-linked companies, on various high-value and cross-border transactions in both the corporate arena and the field of projects. They include the proposed equity acquisition of an insurer valued at approximately RM6 billion and the development of an RM8 billion methanol plant.
Joyce read law at the University of Reading and was admitted as an advocate and solicitor of the High Court of Malaya in January 2018.
Lim Chee Yong ― Energy, Projects & Infrastructure, and International Arbitration Practice
Chee Yong has been a member of the firm’s Energy, Projects & Infrastructure, and International Arbitration Practice, under Dato’ Nitin Nadkarni, since 2016. His main practice covers all forms of international and domestic dispute resolution within the energy, utilities and construction sector. His background is particularly evident in technical disputes where he has the unique ability to understand and dissect complex engineering matters. In recent years, he has advised on numerous disputes involving defective design and construction of highway interchanges, biogas plants, railway system including tunnelling, gas and steam turbines, coal-fired boilers and auxiliary systems (boiler tube failures), primary processing and further processing plants, mixed-use developments and retail malls. He has also assisted Dato’ Nitin in a number of ad-hoc and institutional arbitrations under the AIAC, SIAC, ICC and LCIA.
Chee Yong has been engaged to advise both local clients and foreign investors on dispute management and risk assessment throughout the life cycle of projects. In addition to his main portfolio, he is at present being seconded to support the legal team of an oil & gas joint venture in the largest single construction project ever undertaken within Malaysia. He is also periodically engaged to advise on various bespoke and standard forms of contracts, international and domestic, and provides a pragmatic approach in resolving disputes.
With a first degree in Mechanical Engineering with Business Finance from University College London, Chee Yong then read law at postgraduate level. He is an Incorporated Member of the Institution of Engineers, Malaysia and a member of CIArb. He was called to the Bar of England and Wales in 2016 and subsequently admitted as an advocate and solicitor of the High Court of Malaya in 2017.
Nicola Tang Zhan Ying ― Corporate and Commercial Disputes Practice
Nicola is a corporate and commercial litigator, with a focus on directors’ and shareholders’ disputes, breaches of directors’ duties, partnership disputes, minority oppression and civil fraud. She also regularly advises on corporate insolvency, contentious winding-up proceedings, debt restructuring and asset recovery. Out of court, her dispute resolution practice includes international and domestic commercial arbitration.
She acts for private clients and corporations in a diverse range of industries including investment holdings, construction, manufacturing, plantation, banking, automotive, education, insurance, healthcare and pharmaceutical. Her international clientele includes corporations from the UK, China and Japan.
An ardent advocate, Nicola appears as lead counsel in the conduct of trials and independently handles matters in all tiers of the Malaysian courts. She is a contributor to Malaysian Civil Procedure (White Book) (Thomson Reuters, 2021 edition) and Malaysian Precedents of Pleadings (Bullen & Leake & Jacobs, 2nd Ed, 2020).
Nicola began her journey with the firm as an intern in 2013. A recipient of the JPA scholarship, she graduated with an LLB (Hons) from King’s College London, and is a member of the Honourable Society of the Middle Temple. She returned to the firm in 2016 as a pupil and was admitted as an advocate and solicitor of the High Court of Malaya in 2017. Nicola continues to work closely with her pupil master and mentor, Andrew Chiew Ean Vooi.
Shona Anne Thomas ― Corporate and Commercial Disputes Practice
Shona works principally with SM Shanmugam in the Corporate and Commercial Disputes Practice and has a portfolio which, among others, primarily focuses on tortious and contractual disputes. As a niche, she advises and acts for private healthcare institutions on a range of issues as well as private clients in relation to estate planning, inheritance disputes and all stages of estate administration. In recent years, she has also worked with SM Shanmugam in securities litigation.
Shona is one of the contributors for the Malaysian Civil Procedure (White Book) (Thomson Reuters, 2021 edition), the Malaysian Chapter of The Private Wealth and Private Client Review (The Law Reviews, 9th & 10th editions) and the Annotated Statutes of Malaysia: Companies Commission of Malaysia Act 2001 [Act 614] (LexisNexis, Issue 189). She is also the co-author of various articles published by the firm’s Corporate and Commercial Disputes Practice and the Medico Dento Practice, which have since been picked up by CLJ Malaysia.
Shona, who read law at the University of Liverpool, is a member of the Honourable Society of the Middle Temple and was called to the Bar of England and Wales in 2016 and thereafter admitted as an advocate and solicitor of the High Court of Malaya in 2017. Shona is an accredited civil and commercial mediator by ADRgroup UK and a member of the Medico-Legal Society of Malaysia as well as The Malaysia Middle Temple Alumni Association.
